Indiana Code § 32-31-11-4, took effect on July 1, 2022 for sealing of eviction records in cases where an eviction was filed but an eviction order was not granted, the case was dismissed, or the eviction order was overturned on appeal. The new law permits, in some cases, for a petition to be filed with the court to seal the eviction case so that it is not a public record.
Eviction Sealing
Indiana’s Eviction Sealing law recently went into effect. Forms are now available from Indiana Legal Help to file a request to expunge an eviction record.
For those unable to attend the IN State Bar Association July 12 2022 CLE “Understanding Indiana’s New Eviction Sealing Law”, we have attached the presentation slides and here is a link to obtain a free recording from ISBA. If you missed the CLE or wish to view it again, you can register for the on-demand recording here: CLE Recording Request Form
Note: You DO NOT have to be an attorney nor a member of the ISBA to register and view. The “View from the Bench” portion was presented by Judge Stafford.
